01Who these terms are with
These terms are between you — the business subscribing to the service — and TappyCall, a sole proprietorship of Navidanjum Shaikh, which operates TappyCall.
By creating a workspace or using the service you accept these terms. If you are accepting on behalf of a company, you confirm you are authorised to do so.
02What the service is
TappyCall is a push-to-talk communication service for Android devices, sold to organisations for use by their workers. It is not a consumer product and is not sold for personal use.
The service needs a working internet connection on each device. We do not provide the devices, the connection or the electricity.
03Your workspace and your workers
You are responsible for who you admit to your workspace and for removing people who should no longer have access. You are responsible for lawful use of the service by everyone you admit.
You must not use the service to break the law, to harass anybody, or to interfere with the service or with other customers.
04Personal data, and your responsibilities for your workers
We hold your administrator's email address, any phone number you give us, and your billing records. For that information we are the Data Fiduciary under India's Digital Personal Data Protection Act, 2023, and our Privacy Policy explains what we do with it.
For your workers' information — the names they are known by in your workspace, their devices, and when they were last active — you are the Data Fiduciary and we are your Data Processor. You decide who joins, what each person is called, and when their access ends. We process that information only to run the service for you and on your instructions, and never for our own purposes.
You confirm that you have a lawful basis for putting your workers on TappyCall, and that you have told them the service is in use, what it records, and who in your organisation to ask about it. We cannot tell them ourselves: we deliberately hold no email address or phone number for a worker.
You must not add anyone under 18 to a workspace. The Act requires verifiable consent from a parent or guardian before a child's data may be processed, and TappyCall has no way to obtain it.
If one of your workers asks you for a copy of their information, asks you to correct it, or asks you to delete it, that request is yours to answer. Write to us and we will help you do so.
We will keep your workers' information secure, will not disclose it except as needed to run the service, and will tell you without undue delay if we become aware of a personal data breach affecting it.
05Fees
Prices are shown on our pricing page and are charged in advance for each billing period, beginning on the day you subscribe.
A free trial is offered as described on the pricing page and needs no payment method.
We may change our prices. A change never affects a period you have already paid for.
06Availability
We work to keep the service available, but we do not guarantee uninterrupted operation. It depends on mobile networks, device manufacturers' power management and the internet, none of which we control.
TappyCall is not an emergency service. It must not be relied on as the only way of raising an alarm where a failure could cause injury. Keep whatever emergency procedure your site already has.
07Suspension
We may suspend a workspace for non-payment or for a breach of these terms. A suspended workspace cannot make ordinary transmissions.
Emergency broadcast continues to work on a suspended workspace. We will not let a billing dispute stop a safety call.
08Liability
To the extent the law allows, our total liability for any claim relating to the service is limited to the fees you paid us in the twelve months before the claim.
We are not liable for indirect or consequential loss, including lost profits or lost business.
09Governing law
These terms are governed by the laws of India, and the courts at Ankleshwar have exclusive jurisdiction.
10Changes
We may update these terms. The updated version will be posted here with a new date, and material changes will be emailed to workspace administrators.
11Accepting these terms
You accept these terms and the Privacy Policy when you create a workspace. We record the date and the version you accepted.
If we change these terms materially we will publish the new version with a new date. Continuing to use the service after that means you accept the change; if you do not, you may cancel.
